“Identifying Failure Patterns in Premises Liability Cases”

‘How Small Conditions Combine to Create Foreseeable Harm’

This program introduces a practical framework for identifying failure patterns in premises liability cases.  Rather than focusing on isolated defects, it examines how multiple conditions interact to create predictable outcomes and how to recognize those patterns before they become obvious.

Attendees will learn a four-question analytical tool applicable to any premises case, helping them identify stronger cases earlier, avoid cases that appear viable but don’t hold up, and effectively challenge common defense narratives such as “it passed inspection” or “it worked before.”

Frank Yeager is a forensic consultant specializing in failure pattern analysis and prediction in the built environment, with over thirty years of experience in construction, property inspection, and accessibility evaluation.  A combat veteran of Operation Desert Storm and founder of a nonprofit serving the veteran community, Mr. Yeager brings field-level precision to complex premises liability, construction defect, and accessibility cases.  He has served as an expert witness for plaintiff attorneys across multiple states and is the author of three books on forensic consulting and built environment risk.

“America 250 and More – Educating for Citizenship”

Guest Speakers: Beth Specker, Executive Director of the Rendell Center

At this seminar, Attorney Dave Trevaskis will discuss the importance of law-related education and show how it fits into Rule 6.1 of the Rules of Professional Responsibility (Pro Bono).  He will then make three proposals:

1. Set a goal of having up to 250 classes doing read aloud’s in Lehigh County for Constitution Day during the week of September 11th to September 17th.
2. Encourage lawyers and judges to go into schools all year long and do mock trials for the Be the Jury book.
3. Highlight the upcoming statewide high school mock trials and note that Pennsylvania is hosting the National High School Mock Trial Competition in May of 2028!

David Keller Trevaskis, Esquire, is an attorney and former third grade teacher with a Master’s Degree in Education.  Trevaskis was the Pro Bono coordinator for Legal Services for the Pennsylvania Bar Association (PBA), responsible for helping local bar associations, legal aid programs and other groups who offer legal services across the Commonwealth improve the access to justice for the neediest among us.  He also promotes civic education through such organizations as the PBA, the Pennsylvania Council for the Social Studies (PCSS) and Law, Education and PEACE for Kids (LEAP-Kids).

He supports the Wills for Heroes Program of the PBA’s Young Lawyer Division which has provided, at no cost, first responders and veterans with wills and other estate planning documents. 

Trevaskis has long been a champion of non-violence, having been the designer of and original trainer for Project PEACE (Peaceful Endings through Authorities, Children and Educators), a peer mediation, anti-bullying and youth court program jointly sponsored by the PBA and the Pennsylvania Office of the Attorney General.  A co-author of the 2018 updated text, School Law: Legal Framework, Guiding Principles, and Litigated Areas, David is an expert on school law and school crisis.  He teaches in the classroom and online at Community College of Philadelphia, Gratz College, Arcadia University, and the University of New England.

Mock trial as an educational tool is a passion of Trevaskis and he has been actively involved in the Pennsylvania Statewide High School Mock Trial Program sponsored by the PBA Young Lawyers Division since 1985.  He currently serves on the PBA YLD Mock Trial Program Advisory Group and has past service on the Board of the National High School Mock Trial Competition.  Working with the Rendell Center for Civics and Civic Engagement, Trevaskis works to create mock trials and mock appellate arguments from children’s literature for students of all ages.  He also creates moot court simulations with current and historic United States Supreme Court cases.

In his work with PCSS and LEAP-Kids, Trevaskis supports social studies education from pre-Kindergarten to graduate school.  A two-time president and current Executive Secretary of PCSS and the long-time Executive Director of LEAP-Kids, Trevaskis presents hundreds of programs each year for thousands of educators and students.  He is a celebrated presenter of both history and herstory across the Commonwealth and beyond.

“Mindful Stress Management: An Introduction”

In an era of escalating individual and societal pressures, understanding the mechanics of stress is essential for well-being.  During this seminar, the stressors unique to the work of attorneys will be explored.  Current research highlights how cognitive patterns and the brain’s neurological alarm system – specifically the amygdala – drive the human stress response.  Evidence-based mindfulness practices are increasingly recognized as definitive approaches to effective stress management.  This lecture will explain the psychological mechanisms behind the restorative power of mindfulness.  Additionally, the benefits associated with a daily mindfulness practice will be explored.

At the end of this session, participants will be able to:

• Understand current statistical data regarding the prevalence and impact of daily stress.
• Differentiate the unique stressors of a legal practice.
• Understand the systemic physiological and psychological consequences of chronic, elevated stress.
• Differentiate between two primary mind-body mechanisms that activate the stress response.
• Formulate a comprehensive operational definition of mindfulness.
• Appreciate the evidence-based benefits of establishing a daily mindfulness practice.
• Understand the ways in which mindfulness can decrease stress for attorneys.

Joseph Wieliczko, Psy.D. is a licensed clinical psychologist with 28 years of professional experience. His work has included consulting for the State of New Jersey Division of Disability Determinations, as well as providing psychotherapy, psychological evaluations, and psychological testing services. More than 10 years ago, Dr. Wieliczko developed the Mindful Eating and Stress Management program, an online program that integrated mindfulness practices to help participants explore weight management, their relationship with food, and practical approaches to managing stress. He later transitioned that work into a new online group offering, the Mindful Stress Management Educational Program. This program introduces simple mindfulness practices designed to help participants better understand their relationship with stress and recognize how thoughts, emotions, body awareness, and related factors can influence stress levels. Through mindfulness, participants are encouraged to develop greater self-awareness, calm, self-understanding, and resilience in meeting life’s challenges.
